Arabic Abstract

تناولت في هذه الدراسة موضوع الجرائم المرتبطة بالدعاية الانتخابية وفقا، لأحكام قانون الانتخاب لمجلس النواب الأردني رقم (6) لسنة 2016، و نجد أن المشرع الأردني قد نظم العملية الانتخابية بكافة مراحلها، و التي من ضمنها المرحلة التمهيدية الهامة في العملية الانتخابية و بين أحكامها ومبادئها والأسس التي تنظمها سوآءا في قانون الانتخابات أو في التعليمات التنفيذية الخاصة بقواعد حملات الدعاية الانتخابية لسنة 2016 و بذات الوقت أوجب المشرع الأردني العقاب على كل من يخالف هذه الاحكام القانونية.

و لقد تم من خلال هذا البحث عرض موضوع الدعاية الانتخابية من مختلف الجوانب المادية و المعنوية و القانونية، لذلك تناولت المقصود بالدعاية الانتخابية ثم الوسائل و الأساليب والمبادئ التي تحكم سياقها، ثم ركزت على التنظيم القانوني للدعاية الانتخابية، و بعد ذلك تم دراسة بعض الصور والتطبيقات لجرائم الدعاية الانتخابية و منها الجرائم الماسة بتنظيم الدعاية الانتخابية و المتمثلة بجريمة عدم التزام بالأماكن المخصصة للدعاية الانتخابية وجريمة الدعاية الانتخابية خارج نطاقها الزمني وجريمة تدخل رجال السلطة العامة في الدعاية الانتخابية، وكذلك تناولت الجرائم الماسة بوسائل الدعاية الانتخابية وموضوعها والإنفاق غير المشروع عليها ومنها جريمة الالتزام بالضوابط المحددة لوسائل للدعاية الانتخابية وجريمة مخالفة موضوع الدعاية الانتخابية وجريمة التمويل والإنفاق غير المشروع للدعاية الانتخابية، وقد بينت الى جريمة على حدا من حيث ماهية الجريمة و أركانها و العقوبة بشكل مقارن مع المشرع الفرنسي و المشرع المصري.

و خلص الباحث إلى أن أمر جرائم الدعاية الانتخابية لم يحسم بعد وذلك نتيجة لحداثة هذا الموضوع و سرعة تطور الوسائل المستخدمة في أعمال الدعاية الانتخابية، و إن المشرع لم ينص على جميع هذه الجرائم صراحة حيث أن المشرع الأردني لم يتطرق إلى جريمة التمويل و الإنفاق غير المشروع للدعاية الانتخابية على الرغم من أنه قد تطرق إلى بقية الجرائم ونص عليها بشكل واضح وصريح.

English Abstract

This study dealt with a relatively recent subject, namely, the crimes associated with electoral campaigning in accordance with the provisions of the Jordanian Parliamentary Election Law No.

6 of 2016.

We found that the Jordanian legislator has organized the electoral process in all its stages, including the important preliminary stage in the electoral process, and it has defined its provisions and principles, both in the electoral law and in the executive regulations for the rules for election campaigns for the year 2016.

At the same time, the Jordanian legislator-imposed punishment on anyone who contravenes these legal provisions.

In this study, the subject of electoral campaigning was presented from various material, moral and legal aspects, so it dealt with the meaning of electoral campaigning and then the methods and principles that govern its context, and then focused on the legal organization of election campaigning.

After that, some images and applications for the crimes of electoral campaign were studied, including the crimes that impede the organization of electoral campaign, namely the crime of non-compliance with the places allocated for electoral campaign and the crime of electoral campaign outside the time scale, and the crime of the intervention of public authority officials in the election campaign.

The study also dealt with the crimes related to the means of electoral campaign, the subject matter and the illegal spending, including the crime of adhering to the specific rules of the means of election campaign, the crime of violating electoral campaigning, and the crime of funding and the illegal spending of electoral campaigning.

The study has shown the crime in terms of the nature of the crime and its elements and penalty in a comparative manner with the French legislator and the Egyptian legislator.

The researcher concluded that the issue of electoral campaigning crimes has not yet been resolved due to the recertify of this subject and the rapid development of the means used in the election campaign, and that the legislator did not explicitly state all of these crimes, since the Jordanian legislator did not address the crime of illegal financing and spending on electoral propaganda, although that other crimes were addressed and stated clearly and explicitly.
