Abstract EN

Scholars make research in refute and reject the fundamentalists view with reference to the relationship to Islamic laws and principles through all decades .Islam uses wisdom and evidences to refute and criticize those views of extremists and fundamentalists concerning Islamic principles and laws .This confrontation against them happened ,through the era of these who made their decision and views according to their own efforts and ideas besides the imitators who depend on their own efforts to show their own vision and views infer rules and principles ,they explain ,reasons and justification what they saw logical and reasonable ,end they showed evidences that supported their visions and views .they consider each event according to its circumstances and condition each according to its privacy and nature .

Then draw out the satiable rule that best suit each one .Then generalize I the rules for similar events the found or not found so their reaches are empirical and scientific while the imitates made theoretical and imaginary researches.Concerning such controversy , we can identify two difference views and schools self effort decision who drew their rules and judgments according to actual observation and logical analyze to similar events .

the opposing school and vision represented by traditional who insisted on their extremist notion , they were not willing to accept other views and vision even if convincing and acceptable .

They made certain condition for drawing out and inferring justifications for disputed vision and views , they named ways for inferring justification to generalize judgment and rules for that has been for any events and problem .

If any wanted to know about their partial judgment that has been copied from them , he should read their books and edition that included the names of their writers and authors .

So one can say there was big difference between the two methods and views .

The original scholars were disagreeing on whether the Islamic laws and rules are justified and reasoned or not there are two views concerning this dispute .

The majority of the people stand in favor of that all the judges and the rules of the Islamic orders are reasoned and jusyified according to the benefits of all the people .

But the majority of those rules are justified by unseen reasons what called devotional principle and rules through which we worship Gods such as the portion of alms and the time of prayers and reasoned .

This notion is supported by Sheikh and Mutazila and zahiria .

But this notion shows immorality and impoliteness with the God , The creator of the heaven because it includes a question to the God why He has done so , The God said in verse of Quran " They can be asked why they did so , but no one ask Him why He did so .

Explanation of the three views by using wisdom and evidences in justifying and refuting other views 1- The first view point , seec the possibility of using wisdom absolutely 2- The second view point prohibited using wisdom absolutely 3-The thied view point , see that wisdom can be used if it is perfect , convicting and persuasive and well seen and to prohibit t\it is vague , unseen and not prefect.
