Abstract EN

This study seeks to highlight the double role of the ‘Accession Proof’ to prove the land owner’s property of all that is constructed on his land, on the one hand; and to prove that the land owner has constructed them at his expense, on the other hand.

The ‘Accession Proof’ is, thus, an efficient tool to protect the right of the land property and the stability of the legal situation of the immobile property.

Through the ‘Accession Proof’, the Algerian legislator has exempted the land owner from proving the property of the buildings, the constructions and the plants on his land as far as he proves the property of the land.

The Algerian legislator, as well, has called those who disagree on the proof- that is established according to the article 782 of the Algerian civil law – to use all possible legal ways to confirm their claims.
