Torture and other inhuman cruelties were discouraged by the international conventions of human rights, and had been condemned by national criminal laws, but the confrontation truth to this type of crime is not limited to criminalizing by criminal texts, unless surrounded by these texts procedural guarantees designed to ensure the impunity of the perpetrators.

This study aimed at determining the legal principles guaranteeing not to impunity for the perpetrators of torture from prosecution, and the statement of the legal procedures to ensure disclosure of this type of crime, and the investigation of the perpetrators and ensuring bringing them to justice, and then it dealt with the study authoritative evidence derived from torture and its acceptability in front of the criminal justice system, and finally the study concluded a set of findings and recommendations.
