Arabic Abstract

لقد كان الهدف من هذه الدراسة الوقوف على مسؤولية القيم المدنية وتحديد مفهوم هذه المسؤولية ومدى مسؤولية القيم عن اعماله وبيان نقاط الخلل في التشريعات الناظمة لأعمال القوامة من خلال مراجعة احكام القانون الاردني وبعض التشريعات العربية متخذاً النهج التحليلي المقارن هادفين الى شرح مفصل لبيان مفهوم القيم من خلال النصوص الناظمة له ولقد اعتمدنا منهجية التحليل و المقارنة ما بين النصوص الناظمة وفق احكام القانون الاردني والتشريعات العربية مفسرين للنصوص معالجين لها و قمنا ببيان مواطن النقص فيها وتوصلنا الى مفهوم القوامة وتنظيمه ومسؤوليته تتنازعه عدة قوانين ونصوص متفرقة ما بين القانون المدني و قانون اصول المحاكمات المدنية وقانون الاحوال الشخصية و قانون العقوبات الأمر الذي يجعله خاضعاً لتفسير النصوص و تنازعها حيث لا توجد احكام موحدة ناظمة لهذا العمل القانوني يستطيع رجل القانون أو القاضي الرجوع اليها الا من خلال مراجعة تلك النصوص وتفسيرها من عدة قوانين كذلك نجد أن المشرع يفرق تارة ما بين الحارس القضائي و ما بين القيم من خلال النصوص القانونية حيث لا يوجد تعريف جامع مانع لمفهوم القوامة.

كذلك قمنا بتعريف القيم لغةً ووفق الاصطلاح الشرعي ووفق القانون وبينا التنظيم القانوني للقيم والطبيعة القانونية له من خلال شروطه العامة وكذلك ميزنا القيم عن المفاهيم المشابهة له كالوكالة والحراسة القضائية ووكيل التفليسة.

وقمنا ايضاً بتعريف المسؤولية بنوعيها العقدية والتقصيرية متواصلين من خلال ذلك الى نوع المسؤولية المدنية التي تقع على عاتق القيم ومتى تقع المسؤولية الجزائية عليه.

English Abstract

The purpose of this study was to determine the responsibility of civil values and to define the concept of this responsibility and the extent of responsibility of the values of its work and to identify the points of imbalance in the legislation governing the work of guardianship through reviewing the provisions of the Jordanian law and some Arab legislation taking the comparative analytical approach aiming at a detailed explanation of the concept of values through and we have adopted the methodology of analysis and comparison between the texts governing in accordance with the provisions of the Jordanian law and Arab legislation interpret the texts treat them and made a statement of shortcomings.

We have reached the concept of stewardship, its organization and its responsibility.

It is divided by several laws and separate texts between civil law, civil trials law, personal status law, and penal law.

We also find that the legislator sometimes distinguishes between the guardian and the value of the values through the legal texts where there is no definition of a comprehensive barrier to the concept of stewardship.

We also define the values of language according to the legal terminology and according to the law and the legal organization of the values and the legal nature of it through its general conditions, as well as distinguish values from similar concepts such as the agency and the judicial guard and the agent of bankruptcy.

We have also defined the liability, both contractual and contractual, thereby reaching the kind of civil responsibility that lies with the values and when the criminal responsibility lies with it.
