Arabic Abstract

هذه الدراسة توضح مصطلح الملكية في الإسلام وأقسامها، وضوابطها، ومقارنة ذلك مع المبادئ الاقتصادية الوضعية.

كما تهدف إلى استيعاب أحكام الملكية العامة الخاصة، وأحكامها، وضوابطها وأقسامها ودور ذلك كله في التنمية المستدامة، وهي إشباع حاجات الإنسان في الحاضر مع الأخذ بعين الاعتبار للأجيال مستقبلا، وقد توصل الباحث إلى أن الملكية العامة في الإسلام هي الملكية التي لا تقبل بطبيعتها الملكية الفردية أو ملكيتها تضر بالجماعة؛ كالمعادن الكثيرة والمرافق العامة وغيرها التي هي من طبيعتها، وما تعتريها من أحكام شرعية عامل رئيس في إحداث التنمية المستدامة.

English Abstract

The purpose of this study is to clarify the concept of ownership in Islam, its sections and controls, and compare it with the economic principles of the situation.

It also aims at understanding the provisions of public ownership, especially its provisions, controls and sections, and the role of all this in sustainable development.

In the future, the researcher concluded that the public property in Islam, the property which does not accept by its nature the individual ownership or ownership, is harmful to the community, such as the many minerals, public utilities, etc.

are of its nature and the legal provisions that are the main factor in the development of the Sustainability.
