Abstract EN

Iraqi constitution valid for the year 2005, the parliamentary system, adopted a style for its own regime in First Article stating that Republic of Iraq is an independent sovereign state in which its regime is republican, federal, parliamentarian , representative and democratic .

The most prominent characteristic of its system is that it is based on the separation of the position of the prime Minister and the Government, as the executive power consists of irresponsible president with a responsible cabinet while the cabinet consists of a prime minister and ministers.

Because of the importance of the incumbency of the prime minister, we'll discusshis authority in two chapters In chapter 1, we discuss the mechanism of the appointing of the prime minister in terms of the way andconditions to be provided for his appointing as well as the end of the term.

The second chapter discusses the legislative, executive and judicial terms of reference of the chairman and finally the conclusions and the recommendations as well.
