Abstract EN

The transitional justice is a necessity for the reconstruction of the political system in the country on the bases of legal and political pluralism to insure a well-established democracy, and to move forward toward the future seeking a final and comprehensive settlement to past conflicts by introducing the concept of transitional justice considering it as the way that ensures justice and redress to the victims, and the transition from a painful past to a bright future.

The importance of the study lies in its attempt to shed light on a subject that is considered to be very pivotal by tracking transitional justice mechanisms in Iraq, since the subject of transitional justice is one of the most important topics on the political scene.

Due to the importance of this subject, several institutions were established to achieve this task, as well as to strengthen the process of transforming democracy in Iraq.

However, the work on the ground appears weak in achieving the task set up for it.

We shall tackle this subject through three perspectives, including how the democratic transition in Iraq has taken place, and its role in determining the path of transitional justice, as well as its mechanisms.

Finally we shall embark on the future of transitional justice in Iraq.
