Abstract EN

This article deals with means of proof of the condemnation for misdemeanors and contravention and their correct application in order to Access to approve the correct equation between the right of society and the right of the accused in the defense exposure to some shortcomings which have occurred in the general theory of the penal proof (Articles 212 till 238 Code of Penal Procedure) And in its application caused to many problematic because of disagreement on the interpretation of one legal text, and to propose what we are seeing of solutions.
