التصوير الآلي و أثره في إثبات الحدود : دراسة فقهية

Abstract EN

The aim of this study is to show the verdicts of Islamic doctrine concerning Major violations (Ḥudūds) in automated imaging.

Automated imaging is considered as a modern means that can be relied upon to prove violations.

The question that this paper sought to answer whether it fits to be considered as an evidence to prove these major violations (Ḥudūds) from the Islamic point of view.

Therefore, this study dealt with the definition of automated imaging lingually and conceptually, the types of automated imaging, the definition of these major violations (Ḥudūds) lingually and conceptually, and these violations types.

Then, this study showed the verdict of Islamic doctrine based on the automated imaging; it also dealt with the punishment of spying in using automated imaging as well as the conception of relying upon resumption of law in proving these violations.

The study concluded that relying upon the automated imaging as a main piece of evidence in proving the violation is not sufficient; automated imaging can be useful as a non-final presumption of law in proving the violation and also it can be useful in proving the crimes that required an offending (Tazir) punishment
