Abstract EN

This study examines the legitimacy and the challenge Sharee’a laws present to the civil-juridical system.

It is devided into two main sections.

The first one deals with the challenges Sharee’a laws presents to the civil ones and the conditions under which Sharee’s laws might be used to refute a juridical verdict that is based on civil regulations.

This study compares these cases to the Jordanian civil laws and verdicts.

The second one deals with legitimacy, causes and procedures taken in similar cases.

The study also explains the Islamic point of view that urges civil judges to accept any refutation of a civil verdict as long as it presents a challenge to Sharee’a laws
