Abstract EN

This research makes a comparative Jurisprudence study about determining the age of marriage in the Islamic Shari'a and the Jordanian Personal Status Law.

In fact, the Jordanian Personal Status Law/article No.

(36) for the year 2010, stated that both male and female should have completed eighteen years of age to get married, unless a judge allows the marriage.

Thus, it was important to study this issue from Fiqh perspective to know if this law agrees with our Islamic Shari'a.

Moreover, the study defines marriage and its aims.

It mentions some Jurists' opinions on determining the age of marriage.

After discussing the jurists' opinions and their proofs, the study concludes that in Shari'a, it is permitted to let young people get married but within some conditions and rules the scholars state.

It, also, reveals that not determining the age of marriage is a must for the community benefits.

So, the researchers recommend reconsidering the alteration in the age of marriage.
