Abstract EN

This research addresses the process of the enterprise of Mudaraba money and it's applications in Islamic banks, reviewing and discussing scholars' viewpoints, their pieces of evidence, and pinpointing the most commonly acceptable ones.

The research confirms that such an enterpriser can mix Mudaraba money with his own money or another one if he has permission from the owner or by obtaining an official authorization; also he can mix it with some other money of the same proprietor with permission or full authorization before or after disposing with the first kind of money or if the first money remains of the same value.

Whereas he can't mix it if money value has changed after disposing with it or he cannot obtain the aforementioned permission or full authorization.

Consequently, one can differentiate between two cases in shared Mudaraba: when the Islamic bank can mix depositor's money with its money or with another depositor's money if the bank gets the depositor's permission or full authorization.

The other case is when bank mixes depositor's money with some other money for the same owner before disposing with the first money or if the first money retains its monetary value; however, it can't do this if there is no permission or full authorization.
