Abstract EN

The individual's right for mobility is an essential human entitlement due to man's physical and psychological nature.

Therefore, it is a cornerstone in the rights and freedom of man.

It is also a relative right governed by and subject to laws and restrictions, on both global and national levels.

Hence, constitutions set out the general frames for such right and leave the particularities to the legislator.

In the meantime, this right has won a special attention in heavenly/celestial doctrines at the frontiers of which Islamic legislation stands it has established, long before terrestrial laws, this privilege's concept, restrictions, and laws meanwhile protecting this entitlement by appointing punishments for those who violate and deny it.

The study concluded that the right of movement is needed and necessary in order to exercise a lot of political rights and economic and social development that can't be found without it, addition to the scope of application of Islamic sharia law more comprehensive than the ordinances
