Abstract EN

Arbitration was a well-known tool for conflict resolutions by humanity, and a major civilization requirement for the needed people.

In addition, it constituted a phase of revolution of the law and judicature, by which it was not limited to Islamic states but also known by ancient civilizations.

The Jordanian law was in the forefront of the Arabs world in recognizing of arbitration from legislative point of view, whereby it issued the first independent arbitration legislation law.

Therefore, the importance (aims) of this study will display by comparison between the procedures of arbitration in the Jordanian law and the Islamic legislative rules.

This article will reflect the conceptual framework of arbitration and how it defer from judiciary provision in terms of legitimacy, logic of legitimacy, rules, and the principles of conditional arbitration and its specifications.

This article embodied special room of comparison between arbitration procedures in the Jordanian Law and the Islamic Legislative rules, and resulted in favorable consequences
