Most divine and positive laws have been of great interest to marriage because it is a social necessity that the continuity of life of the human race depends on it.

Marriage finds a legitimate basis in the Qur'an and the Sunnah of the prophet as well as In the determinations of specialists in Islamic law.

It is carried out under a contract requiring conditions and pillars without which this contract is considered null and void.

This is also what is stipulated by the Algerian legislature in the family code where he classified it in vice marriage and null marriage.

The present study aims at exposing religious opinion on certain marriages around which there was a long religious and legal discussion, showing why such a type of marriage is considered to be vice and its consequences, whether from a point of view Religious or legal
