English Abstract

Origin that armed conflicts often turn to the civilian population which directly targets of hostilities by the warring forces.

And many forms of practices that are committed against them from the violence and the killing, torture and hostage-taking, and the looting of property and willful deprivation of food and water, health care, and other forms of practices that lead to spread terror and suffering.

And the suffering civilian population in armed conflicts, the scourge of war, which may force them to flee their places of residence in search of a safe haven to protect them from death or persecution, has practiced against deportation or forcible transfer and deportation acts, by the warring parties to the conflict.

Provides international humanitarian law and the protection of displaced persons 'internally displaced persons' as persons civilians had them legal protection, based on the established rules of protection for the civilian population, and the principle of distinction between them and the people of fighters, which requires the prohibition of attacks on civilians, the people who are not taking part in hostilities in any way.

It is incumbent upon the conflicting parties to maintain their lives and protect them, under the provisions of the Fourth Geneva Convention of 1994 and the Additional Protocols to the Geneva Conventions of 1977, and the rules of customary humanitarian law, which constitute a major source of this law, which obliges parties to the conflict to take all necessary measures in order to avoid situations that might lead to the displacement of civilians.

In addition to the protection provided by the provisions of international humanitarian law, internally displaced persons, which, provides guidelines on internal displacement protection for this category, based on the protection of internally displaced persons, in accordance with international human rights instruments, to ensure that the right to freedom of movement and choice of residence.

Was confirmed by the Universal Declaration of Human Rights, Covenant on Civil and Political Rights and the International Covenant, as the concept of protection against arbitrary displacement to respect the right to housing support, according to the Covenant on Economic, Social and Cultural Rights (ICESCR).
