The Constitutional Council of Algeria is still under executive authority in the constitutional amendment of 2016.

It has the authority to appoint members of the Constitutional Council by presidential decree issued by the President of the Republic.

The latter appoints four members, including the President and Vice-President, Two other members may be elected from the appointed third of the senate.

In addition, when the members of the Council are appointed, they act as constitutional sworn in before the President of the Republic.

The notification system is also subject to the executive and legislative authority without judicial authority.

Then, the Constitutional Council is subject to the executive authority financially, through the preparation of the budget of the Council within the Finance Law, which sets the State budget
