To prove the legitimacy of the popular mobilization as an active player in the existing armed conflict in Iraq , requires astatement of the legal basis and capacity which it carries in the light of the international conventions relevant to armed conflicts...Because the application of the provisions of international humanitarian law on fighters is correlated to the hostilities and the nature of armed conflicts, the legal status has differed for fighters and their categories according to these variables.

Hence, this study seeks to prove the legal status that the popular mobilization marks in Iraq and to prove the inalienable rights of the factions of resistance under the interference of internal and external factors .The derogation of these rights and their confiscation by the ISIS is a gross violation of the rules of international humanitarian law that the ISIS should undergo as a criminal responsibility in the two laws , national and international.
