Abstract EN

This study aims at examining the political nature of the parliamentary oversight over temporary laws and its limitations theoretically and practically.

The political importance of the study stems from subjecting the cognition of the constitutional form of the parliamentary oversight over the temporary law for the political analysis of the activation of the Parliament of its political oversight on the Government.

In addition, the need for disengagement between the limits of the authority of Parliament, the Supreme Court of Justice and the Constitutional Court about the temporary law is discussed.

The result of the study showed that the Parliament’s oversight on temporary laws has a political dimension despite the constitutional form; where this oversight falls under the overall political oversight of the Parliament on the government’s work.

Despite the judicial review of the Supreme Court and the Constitutional Court on the temporary law, the Parliament still has the constitutional authority to accept, amend or repeal the temporary law, in addition to the political oversight on the motivations and adjusts which issued the temporary legislation and which is not subject to the judiciary jurisdiction.

As for the oversight over the goals of the legislation, it is subject to the oversight of the judiciary and Parliament together.

The results of the study also showed that the authority of Parliament does not negate or contradict with the judicial review of constitutional Court and the Supreme Court of Justice, but rather integrate.

There is a weakening of the Parliament in the realization of its political oversight on the government and in holding it accountable.

This weakness was met by the government’s deviation to issue temporary laws.

The study yields recommendations that could contribute to strengthening the network of relationships of the political balance of power between the Parliament and the Government.
