Abstract EN

The Algerian legislator like other legislators on the Arabic and western levels, was interested on the protection of the consumer; who was considered as the weakest part into the contractual process, in comparison to the trader,or the producer or the supplier of the service; then he had issued a collection of legislations that aimed to achieve the necessary legal protection to this side, and he had taken care of amending and replacing them according to the economic progress that the international and national areas had witnessed and still witnessing them.

And the newest and most important of these legislations was the law of 09-03 concerned by the saving of the consumer and the suppression of fraud, through which the legislator had tried to provide more protection to the Algerian consumer; yet the third millennium’s provocations in which a new shapes of contracts had been appeared that were known by the electronic contracts, had emerged a new type of consumers called the electronic consumer, who needed a specific protection; especially, in regard to the specificity of the contractual tool, this obliged the Algerian legislator to fasten in finding ways in order to protect this consumer, and actualizing with these fast developments which the technology of information and communication had known in this field.
