In Algeria, during the Ottoman Rule, an endowment manuscript that dates backs to 1102 H/1691 AD dealt with an exchange contract of one of the Alger's Greatest Mosque endowments.

It was a piece of land owned by the aforementioned Mosque to be exchanged by a big house possessed by a group of Jews to bury their dead's.

Then, the Dey ordered a meeting of the scientific council and a Fatwa was issued.

This research aims at drawing the attention to documents of Ottoman Algerian’s history that are most studying and comprehending the causes upon which the scientific council depended when approving the case although it was comprised of two doctrines; Elmaliki and Elhanafi but eventually was one verdict.
