English Abstract

This research raises the key question of the adequacy of the civil legislation in place to address the vulnerability of the buyers of electronic programs.

This question is justified because most of these legislations were enacted before the great change and revolution that took place in the world of communications and technology, The vastness through which he entered, in a way that made the world like a small room and not a village even, and canceled the distances and the replacement of the method of communication between humans.

In this paper, we have examined the general rules of the Civil Code that regulate the obligation of sellers to ensure exposure and entitlement, as well as the adequacy of the provisions of the Copyright Protection Act to preserve the right of contractors to purchase electronic software, And the possibility that this exposure may lead to the possibility of third parties due to the inability of the seller to pay the exposure.

The importance of this subject has emerged in many ways, most notably the attempt to regulate this guarantee as this subject was not regulated strictly in the law of copyright protection, The Law has the electronic counting software works covered by the protection provided for therein.

So we started our study of the definition of electronic programs and types, and then entered directly to the definition and definition of contracts for the sale of electronic software and its elements and characteristics, as well as the legal basis for the seller's commitment to ensure exposure and entitlement, and then briefly discussed through two sections to clarify the intent and provisions of both the guarantee of exposure and then guarantee entitlement , And concluded the research conclusion concluded the most important findings we have mentioned suggestions and call to take them.
