English Abstract

The philosophy of family law conflict rule between characterization and innovation A study to the effect of principle of equalization on the family law in the light of dialogue between the man made laws and religious ones.The subject matter of this research is not ideological speech of some present issues, but study of the dialogue between the man made law and the Islamic jurisprudence under the arena of Iraqi legal system and the other similar systems.It is true that the Islamic Sheria does not contain only legal rules in its strict sense but also moral ones, yet we will emphasize upon the applicability of Sheria in its legal rules.

The core of the study is the applicable legal rules of private international law, so the dealing with the Sheria law is an introduction to understand the deep roots of Iraqi family law rules and the nature of the system adopted by the Iraqi legislature and the other similar systems
