Arabic Abstract

هدفت هذه الدراسة إلى بيان أحكام فسخ العقد الالكتروني من خلال بيان مدى كفاية القواعد العامة في القانون الأردني لبيان الحالات التي يسمح للمتعاقدين عبر شبكة الإنترنت من فسخ العقد من خلال قانون المعاملات الإلكترونية الأردني رقم (15) لسنة 2015، و بيان أوجه القصور التشريعي، و مدى انسجام الحالات المذكورة بخصوص الفسخ مع طبيعة شبكة الإنترنت المتطورة و بيان نطاق الحماية للمتعاقدين عبر هذه الشبكة.

فجاءت أهم نتائج الدراسة تتمثل في أن مفهوم فسخ العقد الالكتروني ينصرف إلى امكانية فسخ العقد باللجوء إلى القضاء أو الاتفاق، و ربما لوجود شرط فاسخ في نصوص العقد الالكتروني أو لوجود مكنة قانونية بموجب التشريع تسمح بفسخ العقد دون اللجوء الى القضاء و بمجرد رغبة أحد المتعاقدين المنفردة، وهذا هو الأساس القانوني لحالات فسخ العقد الالكتروني.

كما تنصرف آثار فسخ العقد الالكتروني لكلا المتعاقدين، بحيث تلتقي الالتزامات المتبادلة بين طرفي العقد الالكتروني، فتلزم المتعاقد الذي يفسخ العقد بإعادة السلعة للمحترف و تلزم المحترف بإعادة الثمن.

و تمثلت أهم توصيات هذه الدراسة في أنه يجب تضمين قانون المعاملات الالكترونية مكنة الفسخ القانونية بموجب التشريع كبند أو شرط خاص يسمح بفسخ العقد دون اللجوء الى القضاء، و بمجرد رغبة أحد المتعاقدين المنفردة، كتطبيق قانوني لمكنة فسخ العقد الالكتروني.

English Abstract

This study aimed at clarifying the provisions of the electronic contract termination by stating the adequacy of general rules in Jordanian law to indicate the cases that allow online contractors to cancel the contract through the Jordanian Electronic Transactions Law No.

(15) of 2015, The aforementioned cases of termination with the nature of the Internet and the development of the scope of protection for contractors through this network.

The most important results of the study was that the concept of the termination of the electronic contract goes to the possibility of the termination of the contract by resorting to the judiciary or agreement, and perhaps the existence of a condition in the provisions of the contract or the existence of a special legal mechanism under the legislation allows the dissolution of the contract without recourse to the judiciary and the desire of one of the individual contractors, Legal basis for cases of termination of electronic contract.

The effects of the termination of the electronic contract for both contractors will be eliminated, so that the mutual obligations between the parties to the electronic contract will be met.

The contractor who breaks the contract will have to return the goods to the professional and oblige the professional to return the price.

The most important recommendations of this study were that the Electronic Transactions Act should include the legal annulment mechanism under the legislation as a special clause or clause allowing the dissolution of the contract without recourse to the courts, and once a single contractor wished, as a legal application for the termination of the electronic contract.
