Arabic Abstract

التحكيم طريق استثنائي لفض النزاعات، و أصبح من مظاهر العصر التي تتصف بالأهمية لأنها أحدى و سائل حل النزاعات التي تنشأ في المعاملات التجارية الدولية الى جانب القضاء الوطني و التي يتفق الاطراف على حلها عن طريق التحكيم، و يكون أتفاق الأطراف على التحكيم بموجب عقد يستمد منه المحكم سلطته، و تنتهي أثر أرادة الأطراف بصدور حكم التحكيم الواجب تنفيذه، و للوهلة الأولى يظهر موضوع التحكيم في صورة سهلة الا أنه في الواقع يثير عدد من المشاكل القانونية تستوجب الوقوف عندها و التدقيق فيها.

و قد جاءت هذا الدراسة لتسليط الضوء على القيود القانونية التي أقرها المشرع للفصل في اي نزاع ينشاء او يحتمل ان ينشاء بين طرفي النزاع بواسطة التحكيم، بمعنى ان القانون يقرر قيود معينه على جميع اطراف العملية التحكيمية و هي من القواعد الأمرة، القيود الاتفاقية التي هي اتفاق غير ملزم بحكم القانون و يلزم طرفي الاتفاق بما تم عليه فيما بينهم بان يتم الفصل في اي نزاع ينشاء بينهم او يحتمل ان ينشاء بواسطة التحكيم على ان لا يخالف هذا الاتفاق النظام العام و الأدب العامة.

حرصت معظم التشريعات على تنظيم التحكيم و خصصت له قانون خاص يتضمن قيود لجميع مراحل سير العملية التحكيمية سواء ما يتعلق بموضوعة أو الأشخاص او القواعد الإجرائية الواجبة التطبيق وكذلك حدود و سلطات المحكم و رقابة القضاء و تشكيل هيئة التحكيم و صدور الحكم و تنفيذه.

English Abstract

Arbitration is an exceptional way to resolve disputes, And has become a manifestation of the era of importance Because it is one of the means of resolving conflicts that arise in international business transactions As well as national justice Which the parties agree to resolve by arbitration, The parties' agreement to arbitration shall be by contract From which the arbitrator derives its authority, The impact of the will of the parties ends With the award of the arbitration award to be executed, At first glance, the subject of arbitration appears in an easy format In fact, it raises a number of legal problems It requires standing and checking.

This study came to highlight the Legal restrictions approved by the legislator To settle any dispute arises Or likely to arise Between the parties to the dispute through arbitration, In the sense that the law establishes certain restrictions on all parties to the arbitration process It is one of the rules of command Limitations of the Convention Which is a non-legally binding agreement The parties to the Agreement shall be bound by their respective obligations That any dispute arising between them or is likely to arise by arbitration shall be resolved provided that this Agreement does not contravene public order and public morals, Most of the legislation concerned regulating arbitration He was assigned a special law Includes restrictions for all stages of the arbitration process Whether in relation to the place, persons or rules applicable As well as the limits and powers of the arbitrator and the control of the judiciary and the formation of the arbitral tribunal and the issuance of the judgment and its implementation.
