Arabic Abstract

يدور موضوع هذه الدارسة حول موقف المشرعُ الأردني من ازدواج الجنسية بين القانون القديم والجديد، و هو من الموضوعات التي ترتبط بحياة الناس قديما و حديثا، لما له من صلة وثيقة بحياة الناس حيث تعد الجنسية الإطار القانوني و السياسي و الاجتماعي الذي ينظم حياة الأفراد والجماعات.

أن ظاهرة ازدواج الجنسية قد تنشأ نتيجة اختلاف الدول في أسس فرض جنسيتها على أفرادها من ناحية، أو نتيجة اختلاف تشريعات الدول بشأن الجنسية المكتسبة التي يكتسبها الفرد لاحقا على ميلاده بحكم تجنسه بجنسية دولة ما بسبب الزواج المختلط أو بسبب التبعية نتيجة صغر السن، من ناحية أخرى، مما يؤدي إلى نشوء حالات من ازدواج الجنسية بين الأفراد، أن جميع الدول تسعى إلى مكافحة هذه الظاهرة، لما قد يتعرض له الشخص الذي يحمل جنسية أكثر من دولة من مشاكل كثيرة في الحياة العملية و النواحي القانونية، كذلك ما قد تتعرض له الدولة من أضرار و مساوئ نتيجة وجود هؤلاء الأشخاص – الذين يحملون أكثر من جنسية – على أرضها.

و قد عمل المُشرِعُ الأردني على محاربة هذه الظاهرة و الحد منها قدر الإمكان، حيث قام المُشرِعُ الأردني بمكافحة ظاهرة ازدواج الجنسية.

English Abstract

The subject of this study revolves around the position of the Jordanian legislator on the dual nationality between the old and the new law, one of the topics that is related to the lives of people in the past and the present, because it has a close connection to the lives of people were nationality is the legal, political and social framework that regulates the lives of individuals and groups.

That the phenomenon of dual nationality may arise as a result of the difference of States in the grounds for the imposition of their nationality on their part, or as a result of the difference in the legislation of States on the acquired nationality acquired by the individual later on his or her birth by virtue of the nationality of a State because of mixed marriage or because of dependency on the other, which leads to the emergence of cases of dual nationality among individuals, states that all States seek to combat this phenomenon, since a person who has more than one nationality may be exposed to many problems in the working and legal life, as well as the harm and disadvantages of the State As a result of these people - Who hold more than one nationality - at home.

The Jordanian legislator has worked to combat this phenomenon and to limit it to the extent possible.
