Arabic Abstract

هدفت الدراسة لبيان الضمانات التي يتمتع بها المتهم الخاضع للتحقيق و المحاكمة أمام المحكمة الجنائية الدولية، و بيان ما تميزت به المحكمة الجنائية الدولية في أخذها بنظام فعال من الضمانات، و استخدمت الدراسة المنهج الوصفي التحليلي من خلال وصف ضمانات المتهم أمام المحكمة الجنائية الدولية.

وقد اتخذت المحكمة الجنائية الدولية العديد من الضمانات، لاسيما الخاصة بمرحلة التحقيق الابتدائي، و تتضمن تلك الضمانات الضمانات المتعلقة بسلطة التحقيق، و الضمانات المتعلقة بالقواعد الأساسية و إجراءات التحقيق، و ضمانات المتهم عند مباشرة إجراءات التحقيق.

و تتمثل ضمانات المتهم المتعلقة بسلطة التحقيق في تشكيل سلطة التحقيق، و في كيفية ممارسة عملها، و في دور الدائرة التمهيدية في إجراءات التحقيق، و في واجبات المدعي العام و صفاته.

أما بالنسبة لضمانات المتهم المتعلقة بالقواعد الأساسية وإجراءات التحقيق فتتمثل بالأخذ بقاعدة تدوين التحقيق وقاعدة علانية التحقيق.

وهناك ضمانات عند مباشرة إجراءات التحقيق تتمثل بالضمانات أشخاص التي تتعلق بشهادة الشهود والواردة في التشريعات الوطنية كتحليف الشاهد اليمين، و وجود ممنوعون من أداء الشهادة، و حق المتهم بمناقشة الشاهد، و الضمانات المتعلقة بالاستجواب منها حضور المهامي، و الضمانات المتعلقة بالإجراءات الاحتياطية التي تتخذ ضد المتهم كحالة القبض و التوقيف كعدم جواز التوقيف أو حرمان الحرية الا للأسباب المبررة و الداعية لذلك و ضمن اجراءات قانونية، و الحق بطلب الإفراج المؤقت و الحق بالتعويض عن التوقيف غير المشروع.

و توصي الدراسة بأهمية قيام الدول بضمان تحقيق مبدأ التكامل بين اختصاص المحكمة و الاختصاص الوطن، من خلال تعديل تشريعاتها الوطنية في ضوء نظام روما الاساسي، و من الأهمية بمكان أن يتم الاهتمام بالجوانب الإنسانية و الاخلاقية فيما يتعلق بمعاملة المتهم، في المحكمة الجنائية الدولية سواء اثناء التحقيق أو اثناء المحاكمة.

English Abstract

The study aimed at identifying the guarantees that surround the accused subject to investigation and prosecution in national legislation, before the International Criminal Court and its constituencies, and to indicate the characteristics of the International Criminal Court in taking an effective system of safeguards compared to national legislation.

The International Criminal Court (ICC) has taken many guarantees, especially those relating to the initial investigation stage, including those relating to the investigative power, guarantees of basic rules and investigative procedures, and guarantees of the accused when initiating investigation proceedings.

The accused's safeguards regarding the power to investigate constitute the investigative authority, the manner in which it functions, the role of the Pre-Trial Chamber in the investigation proceedings, and the duties and character of the Prosecutor.

As for the accused's guarantees relating to the basic rules and procedures of the investigation, it is the introduction of the rule of recording the investigation and the basis of the investigation.

There are safeguards in the initiation of the investigation procedure, which are the guarantees relating to witness testimony contained in national legislation such as the right to be sworn in, the presence of persons who are not allowed to testify, the right of the accused to discuss the witness, the guarantees of questioning, the presence of the accused, the safeguards of the accused, Such as the prohibition of arrest or deprivation of liberty, except for justified reasons and within legal proceedings, the right to request provisional release and the right to compensation for unlawful arrest.
