Arabic Abstract

أعطى المشرع العماني أهمية كبيرة للهيئة العامة للتأمينات الاجتماعية بمنحها الاستقلال الإداري و المالي و تجلت هذه الأهمية في نص المادة (5) من قانون التأمينات الاجتماعية و ذلك لتمكين الهيئة من القيام بدورها و تحقيق الغاية من إنشائها، إلا أنه يحدث في بعض الأحيان أن تقوم السلطة التنفيذية بالتدخل في أعمال الهيئة سواء أكان ذلك بطريقة مباشرة عن طريق التعاميم و المنشورات المالية أو بصورة غير مباشرة كالتوجيهات و غيرها.

وقد جاءت هذه الدراسة لتسليط الضوء على الاستقلال الإداري و المالي للهيئة و الطبيعة القانونية لأموالها و ذلك بالرجوع الى النصوص القانونية و القرارات القضائية و الفقه لمعالجة هذا الموضوع.

و بالدراسة و التحليل توصل الباحث الى عدة نتائج كان أهمها وجود قصور قانوني في بيان حدود الشخصية المعنوية للهيئة و نطاق الاستقلال الإداري و المالي لها و كذلك وجود قصور تشريعي في معالجة الخلاف القائم على الطبيعة القانونية لأموال التأمينات الاجتماعية، أيضا مبالغة السلطة التنفيذية في التدخل في أعمال و أداء الهيئة و إخضاعها لبعض التعاميم و القرارات الوزارية التي لا تنطبق بشأنها و محاولة السلطة التنفيذية معاملة جميع الهيئات على نطاق واحد دون النظر في ماهية عمل و خصوصية كل هيئة، و أهم ما أوصت به الدراسة ضرورة سد القصور القانوني المتعلق بحدود الاستقلال الإداري و المالي للهيئة و كذلك معالجة الخلاف القائم حول الطبيعة القانونية لأموالها و أيضا الحد من تدخل السلطة التنفيذية في أعمال الهيئة سواء كان في الإشراف أو الرقابة أو التعيين إلا في الاطار الذي حدده القانون.

English Abstract

The Omani legislator gave great importance to the Public Authority for Social Insurance by granting it administrative and financial independence.

This importance is reflected in the provisions of Article 5 of the Social Insurance Law in order to enable the Public Authority to play its role and achieve its purpose.

However, sometimes the executive authority intervenes in the work of the Public Authority directly or indirectly through circulars and financial publications, such as directives and others.

This study is intended to shed light on the administrative and financial independence of the Public Authority and the legal nature of its funds by reference to legal texts, judicial decisions and jurisprudence to address this issue.

After investigation and analysis, the researcher reached several conclusions, the most important being the existence of legal deficiencies in identifying the limits of the moral personality of the General Authority and the scope of its administrative and financial independence.

There is also a legislative deficiency in treating conflicts based on the legal nature of the social insurance's funds.

The study also found an exaggeration from the executive authority in interfering in the work and performance of the General Authority and subjecting it to certain circulars and ministerial decisions, which do not apply to the General Authority itself.

Moreover, the study revealed that the executive authority attempts to treat all the entities from one perspective without referring to their nature and scope of each entity.

The most important recommendations of the study were the need to fill the legal deficiencies related to the limits of the administrative and financial independence of the General Authority.

The study recommended also to handle the dispute over the legal nature of its funds and to limit the interference of the executive authority in the work of the General Authority, whether in supervising, control, or appointment, except in the framework specified by law.
