Arabic Abstract

تناولت هذه الدراسة موضوع نقض المعاهدة الدولية للإخلال الجوهري بأحكامها، و ذلك من خلال بيان مسألة مبدأ احترام المعاهدات الدولية، و كذلك مسألة الإخلال الجوهري كسبب لنقض المعاهدة الدولية، بالإضافة إلى أحكام القضاء الدولي المتعلقة بنقض المعاهدة الدولية بالإخلال الجوهري بأحكامها، ولقد توصلت الدراسة إلى النتائج التالية : يجب أن يكون الإخلال جوهريا لكي يبرر نقض المعاهدة الدولية وفقا لاتفاقية فيينا لقانون المعاهدات لعام 1969، الإخلال الجوهري بأحكام المعاهدات الثنائية يخول للطرف الآخر التمسك به لإنهاء المعاهدة أو إيقاف العمل بها الإخلال الجوهري بأحكام المعاهدات الجماعية يخول لأطراف المعاهدة باتفاق جماعي فيما بينهم إنهاء المعاهدة أو إيقاف العمل بها كليا أو جزئيا في علاقتهم بالطرف المخل أو ما فيما بينهم جميعا، أما فيما يتعلق بآثار النقض فإن النقض بالنسبة للمعاهدات الثنائية ينهيها أما بالنسبة للمعاهدات الجماعية فتبقى المعاهدة ملزمة وسارية المفعول على الرغم من انسحاب أحد أطرافها، و أخيرا أكد القضاء الدولي في العديد من أحكامه أن الإخلال الجوهري هو أحد أسباب إنهاء المعاهدة الدولية أو إيقاف العمل بها، وقد توصل الباحث إلى مجموعة من التوصيات كان أهمها بأن الدولة التي تخل بمعاهدات دولية معينة بشكل متكرر كحجة للتخلص من الالتزامات الملقاة على عاتقها وفقا لنصوص المعاهدة، على المجتمع الدولي اتخاذ إجراء ضدها كعدم إدخالها في معاهدات دولية جديدة، وذلك للحد من نطاق الإخلال الجوهري بالمعاهدات الدولية و التقليص منه قدر الإمكان.

English Abstract

The study examined the revocation of the international treaty due to the substantial violation of its rules through discussing the following: the principle of respect for international treaties; the issue of substantial violation as a reason for revoking the international rule.

The study concluded with the following results: the violation should be substantial to justify revoking the international treaty in accordance with Vienna Law for treaties (1969), the substantial violation with the rules of the dual treaties which delegate a party to termination or stop the treaty; the substantial violation of group treaties in which the delegates the parties to terminate or stop the treaty (whether totally or partially) in their relationship with the violating party or among themselves together.

As for the consequences of revocation, revocation for the dual treaties, the convention might be terminated.

However, regarding the group treaties, they continue valid, binding and in force despite the withdrawal of one of its parties.

Finally, the international jurisdiction in various rules confirmed that the substantial violations is deemed as a reason for terminating or stop applying such convention.

The researcher found a number of recommendations most importantly was that the state, which repeatedly violates certain international treaties as an excuse to dispose its obligations under the treaty's provisions, then the international community must take action against it.

In an effort to limit the fundamental breaches of international treaties and to minimize it as much as possible.
