Arabic Abstract

تعد وظيفه البعثات الدبلوماسية من الوظائف التي تخضع للقانون الداخلي و القانون الدولي و هي أداه تنفيذ السياسية الخارجية للدولة و المرتبطة بالمبعوث الدبلوماسي الذي يقوم بتمثيلها، و يعرف المبعوث الدبلوماسي كسائر موظفي الدولة تعهد إليه مسؤوليات و واجبات تجاه دولته المعتمدة و رعاياها و كذلك اتجاه الدولة المعتمدة لديها، و يعد رئيس البعثة هو الشخص المعين من قبل دولته في دولة أخرى بعد موافقة الدولة المعتمد لديها و هو المسؤول امام حكومته و امام حكومة أو الدولة المعتمد لديها عن جميع التصرفات المتعلقة بالبعثة، و إدارة شؤونها يكون بدرجة سفير وزير مفوض أو قائم بالأعمال و حسب مستوى التمثيل الدبلوماسي بين الدولتين، و أن منح الصفة الدبلوماسية و درجاتها تخص القوانين الداخلية و هؤلاء الاعضاء يكونون تابعين لوزارة الخارجية ويطلق عليهم في الفقه المسلكيون على اعتبار أنهم موظفون الذين يسلكون طريق الدبلوماسية كمهنة والذين يشكلون رئيس البعثة وكادرها من الدبلوماسيين في الدولة المعتمد لديها، وأن وظائف الخدمة الخارجية هي أحدى فئات وظائف الخدمة المدنية العامة، الذين يقومون بتنفيذ سياسة بلدهم الخارجية من خلال الأعمال التي يقوم بها المبعوث الدبلوماسي بناء على طلب من حكومته والتي تعد من الأعمال المتصلة بسيادة دولته و في حالة رفضه القيام بأدائها فأنه سوف يتعرض الى العقوبة التأديبية التي تفرضها دولته لعصيانه أوامرها كونه مسؤولا عن أعماله السياسية والإدارية المناطة إليه، و أن التداخل والتكامل بين الوظيفتين الدبلوماسية القنصلية إذ تكمل أحدهما الأخرى من حيث الواجبات والمهام المناطة للمبعوث الدبلوماسي و القنصلي و التي تصب في صالح دولته و رعاياها، أن أن الموظف الكفؤ يكافئ على جهد و اجتهاده بترقيته فمن الضروري بالمقابل يعاقب الموظف المهمل على أهماله بالعقوبة المناسبة و حسب جسامتها، و لهذا يعد التأديب الضمانة الفعالة لاحترام الموظف المسؤوليات الوظيفية وفق القوانين و الانظمة النافذة في دولته و تنهي مهمة المبعوث الدبلوماسي تخص شخصه، و أسباب متصلة بدولته، و أسباب متعلقة بدولة المعتمد لديها.

English Abstract

The Diplomatic Missions function is subject to both the national and international law.

It is the instrument of implementing the State's foreign policy as it is associated with the diplomatic envoy it represents.

And thus, the diplomatic envoy shall be defined as all a State officers entrusted responsibilities and duties towards their state, their affiliates and towards the state on which they are deputize.

The head of the diplomat mission shall be the person delegated by his State Government to another State government, and is therefore responsible for all the members of the mission members’ conduct, affairs, and for the management of the whole mission.

According to the level of diplomatic representation between the two countries, the head diplomat of the mission might be an ambassador or Minister Plenipotentiary or Charge d'affaires.

The diplomatic member assigning is an internal matter that follows the national law.

But the diplomatic members are under the umbrella of The Ministry of Foreign Affairs and are called the “Positions corps” as officers working in the diplomatic corps and are in the path of diplomacy as a profession.

This mission is consisted of the head of the mission and the diplomatic members in the country in which they are accredited.

This Foreign Service is of the civil service functions whose members 'execute their country's foreign policy through the work of the diplomatic envoy, which is related to the sovereignty of their country.

However, in the event that a mission member refuses to perform his/her duties he/she shall be subject to the disciplinary punishment imposed by his/her state government for disobeying orders.

It’s worth noted here that there is an overlap and complementarity between the diplomatic and consular functions in terms of duties and roles, which are in the interest of his country and its citizens.

Hence, an efficient officer shall be rewarded for his/her efforts and shall be upgraded.

In return, the negligent officer shall be punished for neglecting.

Such action shall boost the officer’s respect towards professional responsibilities in accordance with the laws and regulations in force in his/her country.

While the termination of the diplomatic is related to diplomat personality, country and to the country in which he is accredited.
