Arabic Abstract

تعد جريمة الاتجار بالبشر، واحدة من أخطر الجرائم التي تهدد البشرية في عصرنا الحاضر، كونها تمثل اعتداء على حقوق الإنسان و حريته وكرامته، و هي تعد الشكل الحديث للرق الذي كافحت البشرية للقضاء عليه و التخلص من ذكرياته المؤلمة، و غالبا ما ترتكب هذه الجريمة من قبل عصابات منظمة و تكون عابرة للحدود الوطنية، وهو ما يستلزم تضافر جهود المجتمع الدولي لمكافحتها و التصدي لها و معاقبة مرتكبيها و حماية ضحاياها، الذين غالبا ما يكونوا من النساء و الأطفال و الفئات الضعيفة.

و تأخذ جريمة الاتجار بالبشر أشكالا مختلفة تنضوي تحت ثلاثة عناوين رئيسة هي الاستغلال الجسدي المتمثل بنزع و تجارة الأعضاء البشرية، و الاستغلال الجنسي كاستغلال دعارة الغير و السياحة الجنسية، و الاستغلال الاقتصادي الذي غالبا ما يقع على العمال كالعمل القسري و الممارسات الشبيهة بالرق.

و قد انضمت كل من دولة الكويت والمملكة الأردنية الهاشمية إلى معظم الاتفاقيات و المواثيق و البروتوكولات الدولية التي تهدف إلى مكافحة هذه الجريمة، كما أصدر المشرع الأردني القانون رقم (9) لعام 2009 لمنع الاتجار بالبشر، و أصدر المشرع الكويتي القانون رقم (91) لعام 2013 المتعلق بمكافحة الاتجار بالأشخاص و تهريب المهاجرين، كما تبذل كلتا الدولتان جهودا كبيرة على الصعيد الوطني لمكافحة هذه الجريمة.

و تأتي هذه الدراسة لبيان مفهوم جريمة الاتجار بالبشر، و أسبابها و أشكالها و مدى كفاية الجهود التي تبذلها الكويت و الأردن لمكافحتها، و مدى انسجام هذه الجهود مع الاتفاقيات و المواثيق الدولية.

و قد توصلت هذه الدراسة إلى مجموعة من النتائج من أهمها أن التعريف الذي أورده المشرعان الكويتي و الأردني لجريمة الاتجار بالبشر مطابق للتعريف الذي أورده بروتوكول الأمم المتحدة لمنع وقمع ومعاقبة الاتجار بالأشخاص، و بخاصة النساء و الأطفال لعام 2000، و أن هذه الجريمة هي في غالب الأحيان من الجرائم المنظمة العابرة للحدود الوطنية و هو ما يستلزم تضافر الجهود الدولية لمكافحتها، و أن كلا من الكويت و الأردن جهودا حثيثة لمكافحتها و ملاحقة مرتكبيها و حماية ضحاياها، و لذلك فقد انضمتا إلى معظم المواثيق الدولية المتعلقة بمكافحة هذه الجريمة، و تعد الكويت دولة مقصد للاتجار بالبشر، كما تعد الأردن دولة عبور.

وقد أوصت هذه الدراسة الجهات المختصة في دولة الكويت بتشكيل لجنة وطنية لمنع الاتجار بالبشر على غرار اللجنة المشكلة في الأردن، كما أوصت الجهات المختصة في الأردن بإنشاء مركز إيواء لضحايا الاتجار بالبشر على غرار المركز الذي تم إنشاؤه في الكويت، إضافة إلى مجموعة من التوصيات الأخرى.

English Abstract

Human trafficking is considered one of the most danger crimes that threatens humanity nowadays.

This crime is considered aggression on the man and his freedom and dignity.

It is considered the modern shape of slavery that was fight by human to get of it and its painful memories.

Almost, this crime is committed by the organized bands and exceeding the national borders.

So, the efforts of the international society shall be unified to fight the same and punish these bands and protect the victims whom are mostly of women, children and weak people.

Human trafficking crime takes many shapes under three main titles : 1) body exploitation such as human organs removal and trading, 2) sexual exploitation, such as prostitution and sexual tourism, 3) economical exploitation which may be seen in the forced employment of the labors and slavery – similar practices.

Recently, State of Kuwait and Hashemite Kingdom of Jordan have joined most of these international treaties, agreements and protocols that aim at fighting this crime.

Jordanian legislator has enacted the law no.

9 of 2009 to prohibit human trafficking as well Kuwait legislator has passed law no.

91 of 2013 related to fighting human trafficking and smuggling of migrants.

In addition, the both countries exerted great efforts on national level to combat this crime.

This study aims at stating concept of human trafficking crime and its reasons and forms, extent of the efforts exerted by State of Kuwait and Jordan to combat the same, harmonization between these efforts and international agreements and treaties.

This study came out with some conclusions, mainly with regards to the definition of the Kuwaiti and Jordanian law makers for the crime of trading in human beings, which was identical to the definition mentioned in the United Nations Protocoled to prevent, abort and punish the crime of trading in individuals, especially in women and children, which states that this crime is mostly among trans borders organized crimes, which calls fora joint international efforts to fight.

In this regard, each of Kuwait and Jordan has persistent efforts to fight this crime, and chase the criminals and protect its victims.

Therefore, both Kuwait and Jordan had joint most of the international conventions to fight this crime.

Kuwait is regarded as a destination state for the trade inhuman beings, while Jordan is a transit state.

This study recommended to the appropriate authorities in Kuwait to form a national committee to prevent trading in human beings, and follow example of the committee formed in Jordan.

This study also recommended to the appropriate authorities in Jordan to establish refuge for the victims of trading in human beings, to follow the example of the center established in Kuwait, in addition to other recommendations.
