English Abstract

In this thesis, I discussed the contract of managing the common money – a comparative study between the Iraqi, Egyptian and Jordanian civil laws.

This contract is one of the modern contracts in the civil law of the above countries.

The civil legislator did not provide specific provisions for this contract.

In this study, the concept of the contract will be defined along with its definition after study and knowledge of some of the terms related to the subject of the study, as well as the common ownership and type, with a focus on family ownership and management provisions as a common image of ownership, It also discussed the types of contract and its characteristics and characteristics, and this was discussed in the first chapter of the thesis.

The second chapter discusses the position of the contract of money management by discussing how distinguishes this contract from similar contracts, managing the money, how to appoint the manager and types of administration, and the conditions of choosing the manager.

The third chapter included the reasons and methods of expiry of the communion and dealt with the effects of the contract and how the contract ends the management of the common money, with a short conclusion reached some conclusions and recommendations which I hope to take by the legislator of the States of Iraq, Egypt and Jordan.
