English Abstract

The arbitration clause in the contract of work.

The researcher divided this study into three chapters as follows: Chapter I What is the arbitration clause in the contract of work through three main topics dealing with the first topic the concept of arbitration and the second subject The distinctive criterion of arbitration and its legal nature and the third topic What is the contract of work, The second chapter deals with the arbitration rules in labor contracts through two studies dealing with the first part of the restrictions that apply to arbitration in labor contracts, and the second is the issues that cannot be arbitrated.

The third chapter deals with the legality of recourse to arbitration in labor contracts through two main topics.

The first topic deals with the legal nature of labor rules and the second topic are the conflict of jurisdiction between arbitral tribunals and the judiciary, this study concluded that the use of arbitration leads to privileges and rights that can be used for the worker as a quick adjudicator in cases and the ease of movement of the arbitral tribunal, and the Labor Law does not provide a text prohibiting the arbitration of labor dispute.

Arbitration in labor disputes does not violate provisions This study recommended a number of recommendations, including the need for the Jordanian legislator to add a text authorizing arbitration in labor disputes and the establishment of an institution or department in the Ministry of Labor in order to sponsor and finance arbitration in labor relations.
