إن الدول الحديثة تقوم على دعامة قوية وأساس متين انه الدستور....

فالدستور هو مجموعة القواعد القانونية العليا التي تنظم حياة الدولة بسلطاتها الثلاث، و تحدد اختصاصاتها و واجباتها و آلية عملها و عدم تغول أي واحدة على الاخرى، و كيفية المحافظة على حقوق و حريات الافراد.

إن أغلبية دساتير الدول أفردت جهة معينة تقوم بدور رقابة الدستورية على القوانين والانظمة أو اللوائح تحت عدة مسميات (محكمة دستورية، هيئة رقابة الدستور، مجلس فحص الدستور، و غيرها) لقد اختار الباحث هذه الدراسة بعنوان (المحكمة الدستورية في الاردن و دورها في الرقابة على دستورية القوانين) و ذلك لتحسس واقع رقابة الدستورية في الاردن بشكل ملموس، حيث تطرق بدراسته مع اعتاد عليه الباحثون في مثل هذا البحث.

هذا وقد ختم الباحث دراسته بحزمه من النتائج كان اهمها بان الدستور هو ارقى واسمى القواعد القانونية و أن القوانين و الانظمة ينبغي أن تنصاع لنصوصه و تمتثل لقدسية روحه و انه الدعامة الاساسية لصون الحقوق والحريات التي كفلها الدستور من أفتات السلطة التشريعية و عدم تغول نفوذ السلطة التنفيذية هي رقابة الدستورية على القوانين والانظمة و قد أوصى الباحث بمجموعة من التوصيات اهمها تعديل قانون المحكمة الدستورية ليشمل توسيع اختصاصاتها و آلية تعيين اعضائها و شروطهم و ضماناتهم و كذلك منح بعض الجهات الأخرى حق الطعن المباشر بعدم دستورية القوانين و الانظمة.

The Constitution is not only a set of legal texts, but is the set of supreme legal rules governing the life of the State with its three powers, and define their competencies and duties and mechanism of action and not encroach on each other, And how to preserve the rights and freedoms of individuals.

The majority of the constitutions of states have designated a particular body to play constitutional oversight over laws, regulations or regulations under several names (Constitutional Court, Constitutional Watch, Constitutional Review Council, etc.) The researcher chose this study entitled "Constitutional Court in Jordan and its role in monitoring the constitutionality of laws" in order to make sense of the reality of the constitutional control in Jordan in a concrete way, where he studied his study with the habit of the researchers in such research.

The researcher concluded his study with a firmness of the results, the most important of which is that the constitution is the highest and the most important legal rules, and that laws and regulations should conform to its texts and comply with the sanctity of its spirit and that it is the mainstay of safeguarding the rights and freedoms guaranteed by the constitution.

And regulations.

The researcher recommended a number of recommendations, most important of which is the amendment of the Constitutional Court Law to include the expansion of its powers, the mechanism of appointing its members and their conditions and guarantees, as well as granting some other parties the right to directly challenge the unconstitutionality of laws and regulations
