Arabic Abstract

تناولت هذه الرسالة مخالفات محمد بن الحسن الشيباني لأبي حنيفة في الحج، و هذه الشعيرة تعتبر من أهم العبادات العملية التي يحتاجها المسلم، و يكثر فيها السؤال، خصوصا لمن يؤديها لأول مرة، و تهدف الرسالة إلى إبراز مكانة محمد بن الحسن الشيباني - رحمه الله تعالى – حيث أنه تلميذ أبي حنيفة، إلا أنه خالف شيخه أبا حنيفة في كثير من المسائل في الحج، كما هو واضح في هذه الرسالة، و لا شك أن محمد بن الحسن الشيباني من أكثر أئمة المذهب الحنفي، الذين أظهروا هذا المذهب من خلال المؤلفات الغزيرة التي ألفها في فقه الامام أبي حنيفة.

و اعتمد الباحث على المنهج الاستقرائي باستقراء المسائل التي خالف فيها محمد بن الحسن شيخه أبا حنيفة، و من ثم استخدام المنهج التحليلي بذكر الادلة ومناقشتها و تحليلها و بيان الراجح منها.

و توصل الباحث الى نتائج أهمها: １.

بلغ محمد بن الحسن الشيباني درجة من العلم و الاجتهاد تجعلنا نعتبر بمخالفاته و نفتي بفتواه.

２.

رغم أن محمد بن الحسن الشيباني حنفي المذهب، الا أنه لم يتعصب لمذهبه، بل خالفه في كثير من المسائل.

English Abstract

This dissertation dealt with contravention of Mohammad ibn Al-Hasan Al-Shaibani to Abi Haneefah in Hajj which is considered one of the most important acts acts of worship that Muslims need.

Many questions were asked especially for those who perform it for the first time.

The dissertation aims to highlight the position of Mohammad ibn-Hasan al-Shibani may Allah have mercy on him-where he has the Hanafi doctrine, but he objected sheikh father Hanifa on many issues in the Hajj, as is clear in the dissertation, one of the most prominent Imams of the Hanafi school, who demonstrated this doctrine through the rich person literature of this outstanding character.

The researcher's approach was based on mentioning the offenses of Ibn Al- Hasan at Shibani to Abu Hanifah other statement of the for schools of thought.

The researcher did not come out with anything but rare, and then mentioned the weighting between these statements, using the survey methodology and the method of comparison and analytical method.

The researcher reached to the following results : 1- Mohammad bin al Hasan Al-Shibani is scientific position make us consider his objections and accept his doctrine.

2- We Can take Mohammad Al-Shaibani's says and objections.
