Arabic Abstract

التوثيق مسألة ضرورية لاستقرار حياة البشر.

فلهذا نجد الشريعة الغراء قد ذكرته بل و حضت عليه و أوجبته في بعض القضايا، و من هذه القضايا التي أمرت الشريعة الإسلامية بوجود الشهود فيه هو لب هذه الرسالة و أهم موضوعاتها ألا وهو قضية الإشهاد على الطلاق، حيث أن الرسالة قد بحثت في هذا الموضوع بحثا مفصلا دقيقا يكاد لا يوجد رسالة قد احتوت على ما احتوته هذه الرسالة من أقوال للعلماء الإجلاء و أدلة، و مناقشات، و ترجيحات.

و بعد البحث و الاستقراء و الاستقصاء و المقارنات توصل الباحث لما يلي : 1 - أن التوثيق له صور ثلاث فإما أن يكون كتابيا أو إشهاديا أو عن طريق الترجيح وإمعان النظر 2 - أن هنالك شروطا للشهود لا بد من تحققها حتى يصح أن يكون الشاهد شاهدا على عقد النكاح و الطلاق و الرجعة.

3 - الشهود شرط صحة لوقوع الطلاق، و هذا ما دل عليه القرآن و السنة و أقوال الصحابة و التابعين.

4 - لا يوجد نص منطوق قد وقف عليه الباحث يفيد إفادة قطعية على وقوع الطلاق من غير إشهاد، سواء أكان النص من كتاب الله أو من سنة رسول الله أو من أقوال و أفعال الصحابة و التابعين، مع العلم ان الباحث قد اطلع بفضل الله على الكثير الكثير من كتب التفسير والحديث و وقف الباحث مع آثار كثيرة جدا للصحابة و التابعين متعلقة تعلقا متينا بهذا الموضوع.

و مع هذا لم يقف على دليل قطعي مفاده أن الطلاق يقع من غير إشهاد.

5 - ذكرت الرسالة أدلة منطوقة مفادها أن الطلاق من غير إشهاد هو طلاق بدعي و أنه لا يقع، و كل ما ذكرنا سابقا بخصوص الاشهاد على الطلاق و هل يقع الطلاق من غير شهود مفصل وبإسهاب، بل لعله يعاب علينا الإسهاب و كثرة النقل لهذا الموضوع في هذه الرسالة و هذا كله بفضل الله وحده.

6 - بينت الرسالة الفوائد العظيمة و الجليلة للإشهاد على الطلاق.

7 - وجوب الإشهاد للرجعة و بيان أهمية ذلك للمجتمع.

English Abstract

Documentation is essential to the stability of human life , So that we find law have said it and encouraged it and required in some cases some of these issues that Islamic law ordered witnesses in is the heart of this letter and the most important topic is the issue of certification of a divorce, so that the message might have looked at this topic discussed in detail hardly subtle message contained this message that contained statements of scientists, guides and Discussions and ideas at all And through research and inquiry and interpretation the researcher has included the following: 1.

The documentation has three images, either my book or my certification or by weighting and careful consideration.

2.

That there are conditions for witnesses has to be achieved so that the witness is a witness to the marriage contract.

3-witnesses are requirements for divorce, this is evidenced by the Quran and Sunnah, the sayings of the companions and followers.

there is no operative text might where the researcher has stopped int categorical benefited divorce without certification, whether the text of the book of Allah or Allah's Messenger or the words and deeds of the sahaabah and taabi'een, knowing that the researcher had briefed thanks to Allah on lots and lots of books and modern interpretations Researcher, and stopped with too many effects of the companions and followers attached to this topic, however no conclusive evidence stands that divorce is not certification.

the message proved spoken evidence stated that divorce without certification is an innovated divorce, and everything mentioned earlier, perhaps even broadly detailed maligned us frequent transportation to this subject – certification of divorce- in this message and it's all thanks to Allah alone.
