Arabic Abstract

تناول الباحث الحماية المدنية للحق المعنوي للمؤلف، بما يتمتع به هذا الحق من خصائص تتمثل بعدم قابليته للتصرف فيه، و كذلك عدم قابليته للحجز عليه، و أيضا عدم قابليته للانتقال إلى الغير، و عدم قابليته للتقادم، و الحق المعنوي للمؤلف يتمتع بسلسلة من الحقوق المعنوية التي كفلها المشرعان الأردني و العراقي، كحقه في تقرير النشر و نسبه المصنف إليه و التعديل و السحب من التداول و دفع التعدي على المصنف من قبل الغير، و كما اشترط القانون أن يتوافر في المصنف محل الحماية بعنصر الابتكار و ظهوره إلى الوجود بشكل مادي محسوس، و كذلك نطاق الحماية المدنية على الحق المعنوي للمؤلف، و من هي المصنفات التي تكون محمية في ظل القانون، و كذلك المصنفات التي لا تشملها الحماية المدنية، و سبل الوسائل المدنية و الجزاء لمن تعرضت حقوقه إلى الاعتداء، كما يتمتع المؤلف في حال أصيب بضرر جراء الاعتداء على مصنفه أن يلجأ إلى المحكمة المختصة بوقف الاعتداء و المطالبة بالتعويض.

و توصلت الدراسة إلى عدة نتائج، منها : أن الحق المعنوي للمؤلف هو صلة تربط المصنف بمؤلفه، و تعطيه صلاحيات و سلطات تهدف إلى إثبات العائدية للمؤلف، و هو أيضا سلطة مغايرة في طبيعتها القانونية عن الحق المالي، لأن الحق المعنوي يسبق وجوده الحق المالي، ذلك أن من دون الحق المعنوي لا يوجد هنالك حق مالي لما يتمتع به هذا الحق من ارتباط وثيق بينه و بين الحق المالي، لأن الحماية المدنية للحق المعنوي و المحافظة عليه يزيد من النفع المالي للمؤلف.

English Abstract

This research discusses civil law protection of authors’ moral rights, which are characterized by not being subject to alteration, expropriation, transferability to others, or expiration.

The author has a number of moral rights that are guaranteed by Jordanian and Iraqi legislators, including the rights of publication, attribution, modification, withdrawal from circulation, and protection against violation by others.

The law has also stipulated that works that are subject to protection must involve creativity and must have materially come into being.

Furthermore, civil law defines the scope of the protection of moral rights and defines which works are covered by this protection.

It defines the civil and criminal legal options available to anyone whose moral rights are violated, and it gives authors whose interests are harmed the right to seek compensation through an appropriate court.

This study has a reached a number of conclusions, and one among them is that moral rights are a relationship that links the author to their work, giving the author the power and authority to prove the work’s attribution to the author.

It has also concluded that moral rights are distinct in law from financial rights.

Moral rights come into being before financial rights, because without moral rights there are no financial rights; the latter is closely tied to the former.

The civil law protection of moral rights increases the financial benefits of the author.
