Abstract EN

Study deals with substantive provisions of reproduction - related crimes provided for in Federal Decree Law No (4) of 2016.

It throws spotlight on the provisions of the crime of providing the assisted reproductive technology in vitro fertilization.

Study sets forth elements and penalty prescribed for that crime.

Study sums up with that the prescribed penalties made no distinction between in vitro fertilization performed on unmarried couples, and that performed on married ones without their written consent.

Study also noted that the prescribed fine was out of proportion to the crime of illegally performing in vitro fertilization operations.

Study also touches upon regulation of reproduction crime in terms of elements and prescribed penalty, and sums up with that legislator prescribed one penalty for that crime making no distinction between the two acts of illegal regulation of reproduction and illegal deprivation of reproduction.

Study sets forth Libyan Legislator approach to deprivation of reproduction and its requirements.

Finally, study turns spotlight on abortion crime in terms of cases permitted by federal law and prescribed penalties for violating conditions set out for each case.

Study also noted that legislator commuted the penalty of a physician who performs abortion operation contrary to the set out conditions, and that legislator did not prescribe a fine along with imprisonment.

English legislator approach in this regard was also demonstrated by the study.

Key recommendations and findings of the study include the need for UAE legislator's intervention to introduce amendments to Federal Decree Law No (4) of 2016 concerning reproduction – related crimes
