Abstract EN

This study focuses on the obligation of a bank to examine documents, as part of issuing documentary credit, according to the Uniform Customs and Practice for Documentary Credits (Bulletin 600) and comparative jurisprudence.

Using an analytical and comparative approach, the study deals with the process of examining and documents as a legal obligation that requires legal knowledge, experience in the field of credit, and accuracy of the procedure since it effects the issuing bank and the other parties to the letter of credit.

The study first explores the concept of the letter of credit (definition, clarification of the different types, its legal relationships, and the legal regulation of documentary credits).

The study then analyzes the bank’s commitment to examine and screen documents, explains the rules to be observed for such obligations, identifies the limits of the liability, and discusses its elimination.

The study has been divided into three sections, in addition to the conclusion.
