Abstract EN

In this research, we shall deal with the administrative dispute that accepts arbitration by the concept of administrative dispute from the jurisprudence ;legislative ; and judiciaryv point of view , focusing on its froms.

We shall also try to chow and determine the criterion on wich the administrative dispute accepted for arbitration as a substitute for the judiciary , if financial rights are concerned and reconcilable and aliienble.

Arbitration as general concept, according to Articl 1006 of civil and administrative procedures code , cannot be applied in issues linked to public order wich are inalienable ;consequently , it cannot be applied in disputes belonging to justice of rights or personal justice , i.e ; those wich are based on the protection of any financial right that is waible even if these right arise from the legal ties related to public order , and there are legal peremptory rules that organize these rights.
