Abstract EN

The purpose of this research is to study the contract in electronic contracts, the latter, which enables the human by shortening the effort and time and rounded distances.

The electronic contracts came as a result of the information technology revolution witnessed in the world recently, where information technology is all fields, especially the commercial field, because of the availability of services and guarantees that make the recipient often accepted, because of the many advantages.

Which made it impossible to ignore digitization and technology in any way at the present time.

The purpose of this research is to determine the moment of the electronic contract.

This is due to the importance of knowing this moment due to its implications.

Therefore, there is a great debate between jurisprudence and law, which we will try to shed light on, through the general rules of contracting laws In order to determine their suitability or limitations in some cases, to compare them with the rules established in the electronic transactions laws in many legislations, as well as to present the position of the Algerian legislator on all this.
