The dismissal of a public official who neglected his job in the public service; is the most serious administrative procedure, which excommunicates him from disciplinary guarantees on the one hand; and no future recruitment on the other hand, this what makes the Algerian legislator determines the substantive and procedural controls of the dismissal decision of a public official neglected his job, by Executive Decree N° 17-321.

The decree granted to the public official some rights against the decision of dismissal, which included guarantees before the dismissal decision; guarantees related to the same decision and guarantees after the application of the decision.
