While competition occurs clearly in the calls for tenders - which is considered as a general rule for the execution of public transactions - the administration choice -having discretion power - of amicable agreement to execute its transactions raises many problems associated with the realization , of the competition principle.

Because the principle of competition almost disappears in a simple amicable agreement, we'll try -in this research work- to investigate the realization of the afore mentioned principle when the administration adopted the amicable agreement after consultation procedure to execute its transactions.
