The researcher chose this subject to declare the opinions of our scholars of the Islamic doctrines and comparing these opinions widely with the positive laws.

The research was divided into two chapters and each chapter was divided into four sections.

The first Chapter: Defining the will and its legitimacy, basic elements, forms and the attitude of the law.

It contains four sections: The first section: Defining the will.

The second section: The evidences of the will legitimacy.

The third section: the basic elements of the will.

The fourth section: The forms of the will and the attitude of the law.

While the second chapter: The ways of making will in the Sharia and law.

It also contains four sections.

The first section: Making the will by using the «idiom».

The second section: The active expression «writing».

The third section: Making the will by using the «sign».

The fourth section: The attitude of the law from making the will.

Then the researcher writes the most important conclusions at the send with the list of the sources
