Tourism and travel agencies play an important role in promoting tourism, it is the fundamental element that binds the tourist on the one hand with other operators in the field on the other hand.

The activity of tourism and travel agencies is governed by act 99-06 which repealed the former act 99-05, and regulated by executive decree 17-161, which in turn repealed executive decree 2000-48, which demonstrates the state’s commitment to implimenting a rigourous and effective system to guarantee the safety and well-being of tourists and thus strengthen the national economy.

The new law and its executive decree were an attempt by the legislator to identify the activity of tourism and travel agencies on all sides, however, there are still some gaps to be filled, indeed, the tourism and travel contract is a complex contract, it is a combination of several special contracts, which requires the determination of its legal nature to deduce the law applicable to all cases of figures
