The Wilaya in the marriage contract is one of the important and sensitive topics in family law.

It has stirred up controversy between scholars of Charia and law in the ancient and modern.

This controversy is due to disagreement on the texts contained in that both in terms of constancy or semantics.

the controversy has increased sharply on this subject in Algeria when embarking on family law reform in 2005.

This is what i prompted me to search for the fact of the legal status of the Wali in the marriage contract through the books of fiqh, law and also court rulings.
