Ensuring the real enjoyment of all human rights, is the duty of the state, in it’s capacity as the principal debtor, so the state has to work hardly to realize the human rights and eliminate the exclusion, marginalization, poverty and corruption.
This reinforces the need to a legal constructing mainly based on the idea of dignity, participation and prosperity.

Assurer la jouissance effective de tous les droits de l'homme, est une obligation d’Etat.
Ce dernier, doit de ce fait, fournir plus d’efforts pour les garantir et en même temps de réduire l'exclusion et la marginalisation, la pauvreté et la corruption.
Ce qui permet de renforcer la nécessité d’une construction juridique basée essentiellement sur l’idée du droit à la dignité humaine, la participation et le bien-être
