International mechanisms, embodied both by international organizations and by international investment conventions, play a major role in guaranteeing and protecting foreign investment by establishing uniform legal rules for equal treatment of investments between exporting countries and host countries.
Such an approach aims at achieving a balance between the paradoxical interests of the host State and the foreign investor.
This contradiction can be explained by the increasing number of cases brought before international arbitration tribunals concerning the respect of conditions of lawfulness of expropriation.

Les mécanismes internationaux, incarné tant par les organisations internationales que par les conventions internationals de l’investissement, jouent un rôle majeur dans la garantie et la protection des investissements étrangers, et ce, en établissant des règles juridiques uniformes pour un traitement égalitante des investissements entre les pays exportateurs et les pays d’accueil.
Une telle demarche vise à réaliser un equilibre entre les interȇts paradoxaux de l’Etat hôte et l’investisseur étranger.
Cette contradiction s’explique par la multiplication des affaires portées devant les tribunaux arbitraux internationaux concernant le respect des conditions de licéité d’expropriation.
