Reduction of prices remains, according to law, prohibited only in case it is accompanied with abuses making it as an act that affects the market competition regulations.
That’s why it is set prohibited by the Algerian legislator in forbidding the offer or apply of prices abusively low, as it is certified as a restrictive practice of the market competition in virtue of the ordinance related to the concurrence (market value regulation).
However, the law related to trade practices prohibits any other nearby practice in link with the former one.
It is a resale for loss which completes this latter, which is not established as a restrictive practice towards the concurrence, but it is an illicit trade practice.
Thus, the purpose of this study is to operate (set) a comparison between the two practices in matter.
Abstract FRE
La réduction des prix n’est, en principe, prohibée que si elle est accompagnée d’abus qui fait d’elle un acte portant atteinte à la concurrence.
D’où sa prohibition par le législateur algérien en interdisant l’offre ou pratique des prix abusivement bas, qualifiée de pratique restrictive de la concurrence, et ce, en vertu de l’ordonnance relative à la concurrence.
Par ailleurs, la loi relative aux pratiques commerciales interdit une autre pratique voisine à la première.
Il s’agit de la revente à perte qui complète cette dernière et qui n’est pas qualifiée de pratique restrictive de la concurrence, mais d’une pratique commerciale illicite.
Ainsi, l’objet de cette étude est d’opérer une comparaison entre les deux pratiques en question.
